communication that it was on a collision course with the san francisco bay bridge. good evening, everyone. i'm carolyn johnson. >> and i'm dan ashley. did that warning come in time for the bar pilot and the crew to do anything? that will be a key question as the investigation begins in ernest. tonight a representative from the national transportation safety board is in the bay area. abc7 news reporter cornell bernard is live with what we are learning about the moments before the accident. cornell? >> yes, before yesterday's accident there was a warning. ing way tanker was too close to the bay bridge. tonight as you can see that oil tanker remains anchored off treasure island. tomorrow the ntsb gets to work to find out what happened. the coast guard has listened to recordings of radio traffic and confirms the tanker overseas rain bar was warned it was on a collision course with the tower of the bay bridge. it came from the vessel traffic service. the new information is sure to be a factor when the ntsb begins its investigation.

>> what we will be doing is gathering investigation. throughout the investigation we will be looking at the van, the machine and the environment. we will determine what caused this. >> sky 7hd shows coast guard investigators on board the overseas rain bar. they interest vied the bar pilot who was at the hf the acc. the time of the accident. he passed an alcohol tessult ofg result of a drug test are still pending. investigators also looked at the crushed hole from inside the ship. >> we continue to run through the records and conduct technical analysis. we will look at the internals of the vessel to get a good internal analysis of the hull itself. >> the oil tanker was empty when it sideswiped the fenders. the bridge itself was not damaged. >> i guess the first thought that came to my mind when i heard about it was the word unbelievable. >> long-time san francisco maritime attorney is not a part of the investigation, but has represented dozens of captains and bar pilots following accidents. >> weourse the course

recorder. it is like a black box thing. it would show what the maneuvers of the vessel was. i want to look at the engine room logs. i would want to look at the deck log. >> the ntsb investigation could take up to a year to complete. its findings may prevent future accidents from happening again. live on treasure island, cornell bernard, abc7 news. >> thank you. the abc7 news i team has uncovered new information about the man piloting the overseas raymar at the time of the accident. they found three addresses under his name, one in san francisco, one in wyoming and what appears to be his most current in maryland. you are seeing video provided to the i team by the san francisco bar pilots. the bar pilots work one week on and one week off, but they can trade shifts. the i team's dan noyes asked the shipping industry officials about the possibility of pilot fatigue. the possibility that the bar pilot came to san francisco from maryland right before the

clouds overhead. fog has formed down below. look at the visibility where it is foggy. concord reporting visibility down to two and a half miles and three miles in half moon bay. give yourself extra time for the morning commute. it will slow you down in spots. here is a sign of the cold system that is coming. it is producing rain and snow in the pacific northwest. that will be heading down toward the bay area.ll show youl need the umbrellas and how low the local snow levels are going to go in a few minutes. carolyn? >> thank you. it was a fight to the death between a man and an intruder in his apartment. tonight police have been interviewing the tenant who killed that intruder. it happened at the apartment complex in pittsburgh on easterly land road. that's where alan wang is live with the story. alan? >> carolyn, police believe it was likely an attempted burglary. but the tenant was in his home alone when the intruder tried to break in.

police say when the male tenant in apartment 124 looked through his peep hole and saw someone trying to break in he immediately went to his bedroom and grabbed his gun. >> by the time you make it back to the front door, he is confronted by the suspect who was no you inside of his house. the suspect engages in a physical altercation. during the altercation, the resident loses control of the firearm. ntruder in the neckes to stab killing him. the intruder was a 54-year-old pittsburgh man with an extensive criminal history. >> it does appear that the homeowner was acting in self-defense. jay he shouldn't have been breaking into his house. jay there isn't much sympathy for the dead man here at the villa serena apartments. they say it has been relat therut now there is concern. >> looks like that is what i will have to do next time yomebody comes house. times are rough. it seems like they don't even care if you are there or not.

with crime on the rise, they are taking the law into their own hands. it is something they are contemplating because they can relate to the neighbor who fought back. >> he is a nice guy. he dropped them off and family oriented. he is a nice guy. >> police say the inyou had truer had a gun that turned out to be a fake one. they also arrested two other people nearby who they believe had some connection to the intruder. reporting live in pittsburgh, ery much. alan, thanks very muc. and just three blocks away, another pittsburgh resident took the law into his own hands and apprehended a burglary suspect. neighbors told police that they saw four people escaping with valuables from a house. police arrested three of them, and then a fourth tried to hide in a neighbor's garage. that homeowner armed himself and caught that fourth person at gun point. >> my neighbor's dog kept on barking, so i looked in my garage and peeked around the

side of the bikes and there he was. he surprised me. >> you can bet it did. officers say three of the four people arrested are juveniles. police say the suspect stole electronics and jewelry from the house. new at 11:00, a burglar has stolen a golden box estimated to be worth $800,000. this is the museum's second burglary in two months. police say someone broke in early monday morning, and that person stole the box along with a chunk of quartz from the gold rush area. in mid-november someone stole gold nuggets and other items. they made no arrest in either case. elective surgeries are postponed until tomorrow evening as it recovers from a water emergency. officials issued a code dry at the medical center at its merit pavilion campus. water was restored after 5:00 p.m. but for more than four hours, surgeries were canceled and no one could use sinks or flushed toilets. it affects all aspects of the

hospital except for urgent patient care issues. the hospital blames it on a utility failure, but they would not elaborate. governor jerry brown says he will be here to, quote, kick around for a longtime after completing radiation treatment for prostate cancer. >> i'm ready. i am raring to go. don't expect me to leave too soon. >> the 70 -- 74-year-old governor says he is finished with his treatment. it is going great. brown had surgery to remove a growth on his nodes. the governor general will release his proposed budget and deliver his state of the state address on january 24th. lance armstrong is preparing for his first interview since being banned from cycling for life. he will sit down with oprah winfrey, and he is expected to talk about the doping scandal, of course. he has always de night -- denied the accusations. then last week there were reports that he was considering a public admission. well, up next, diet drinks. they promise to help you keep

several gun forums in the bay area. these were triggered by the elementary school shooting in connecticut and hundreds of people with differing opinions on gun rights filled napa city hall. john alston joins us there live. john? >> carolyn, it wrapped up a short time ago. it was billed as a chance for the local congressman to hear from citizens about ways to stop gun violence, but also to deal with issues like mental health programs and violence in the entertainment industry. the evening featured passionate give and take on the subject of gun control and gun rights. >> for you to sit there and try to limit and encourage people to limit our constitution is just appalling. >> at times the man getting

the backlash was congressman mike thompson who was just appointed by nancy pelosi to lead a gun violence prevention task force. it follows it is -- it follows the mass shooting of 20 elementary school students and several in newtown, connecticut. he wants to ban the semiautomatic rifle used in the attack. >> as a gun owner and hunter, i don't think they do us any good. i don't think they should be in our communities and in our streets. >> the over flow crowd of about 200 spilled down the hallway of napa city hall. they heard a few speakers repeat the nra's call to have armed guards in all schools. >> those kids might have been alive if a few of the office personnel or some of the people had a concealed carry permit to protect our children. >> that idea did not go unchallenged. >> i know i will get booed, but when i listen to the leadership of the nra saying we need more guns in the

launch nonstop 787 service from mineta san jose airport to tokyo this friday. scientists believe diet drinks could lead to depression. they looked at artificially sweetened sodas, juices and teas, and adults who consumed four drinks a day increased their risk of depression. it does not proof that diet drinks cause it, but people dealing with diabeteses and obesity consume diet drinks and those conditions can lead to depression. a pair of turkeys is running loose in a san jose neighborhood, and wildlife officials are worried they could be in danger. the turkeys have been spotted near first street and i-880 since the holidays. wildlife emergency services shot this video after neighbors complained. it is a pretty good size toury could. however they will not remove the turkeys because some oppose taking the birds away. the group wild rescue says if the birds remain they could be

killed by a car, a person. it is getting marketly colder outside. >> indeed, very chilly and rain is coming. sand jaw patel is here with the forecast. >> you haven't seen cold yet. some of the coldest air of the season is about to arrive, and it will all arrive starting tomorrow. it will start to move in and settle in by thursday into friday. right now live doppler 7hd is showing you clouds overhead. we have high clouds and fog down below in patches. 40s, 50s, 39 in concord. today's high temperatures were anywhere from the 50s to the upper 60s. a real mild day in most areas except for the inland valleys where the fog is snow to lift. patchy valley fog tonight. tomorrow afternoon we will see a few showers and turning colder thursday into friday. tomorrow morning watch out for the fog. give yourself extra time for the morning chute. temperatures, most areas in the 40s will see a few upper

30s in the coldest inland valleys. and when you leave home, you might want to carry your umbrella with you. we do have a cold system coming out of the gulf of alaska that will bring scattered light showers, and it will be turning colder. let me show you a computer animation. 5:00 a.m. when you are heading out the door some of you are starting your commute early. you will see some clouds. if you are taking your kids to school you will just see clouds of the by 3:00 p.m. a few showers will develop ahead of this cold front. this cold front is not expected to bring a lot of moisture. the next little batch is thursday morning at 3:00 a.m. the snow levels will be coming down 1500 to 2,000 feet. don't be surprised if some of the highest peaks get a few flurries or dustings on thursday. we will start to see the sun breaking through by thursday afternoon and the rainfall total is not impressive with this one. anywhere from nothing to a 10th of an inch. a hit or miss shower will produce snow in the high

country tomorrow night. 46 in tahoe. we are looking at snow flurries on thursday. if you have travel plans on friday, partly cloudy. no problems if you will enjoy the fresh powder going into the weekend. but it is only going to amount to several inches. one thing i want to pass along are the highest tides of the year are coming up over the next three days. over seven feet tomorrow and over seven feet thursday, friday for san francisco in the morning. coyote creek in the south bay looking at high tides of over 10 feet the next three days. please keep that in mind. coastal areas may see some minor low-lying flooding. just be aware as the tides run higher. tomorrow afternoon the temperatures are running cooler. low to mid50s. a few showers developing. could see some snow around lake county, especially around elevations around 1500 feet and around the monterey bay. midto upper 50s for your highs. the possibility of a few showers late at night. here is a look at the forecast for the 49ers up against the

temperatures possibly hitting 130 degrees. scenes like this are becoming more common. look at this nasa imagery showing the entire planet has gotten hotter in recent decades. here in america, 2012 was not only the warmest year on record, but the second most extreme, featuring tornadoes, wildfires, a massive drought, and, of course, superstorm sandy. many cities had record warmth, including washington, d.c., where a lack of action on man made climate change is likely to mean 2012 is just a glimpse into an unpleasant future, according to many scientists. how do we prepare? take stock of where you live and make some sensible precautions. consider buying flood insurance or raising up your water heater if it's in the basement and look at perhaps a generator. dan harris, abc news, new york. >> how about all the folks that said oh, this climate crisis is nonsense. no global warming, what are they saying now? >> it's just interesting to me. i'm no scientist, but if for
